Patient Grievances
Overview
The Network processes grievances from patients, their representatives, family members, professionals, advocates, and State Survey agencies, related to the quality and safety of care in ESRD certified facilities. Concerns can be filed with the Network by phone, fax, or postal mail.
Email is not a secure method of communication. We recommend contacting us by phone or fax to file a grievance. If you submit a grievance by email, Network staff will call you to discuss next steps and clarify any details as needed.
What Happens
When the Network is contacted regarding a concern, it will attempt to resolve the issue in one of the following ways:

Assist the patient to organize his/her thoughts about a situation and provide feedback so that he/she can address the issue on his/her own, if desired;

With permission from the patient, the Network may contact the facility directly to gather information and attempt to resolve the matter;

The facility may be required to complete an Improvement Plan to correct problems;

More serious issues may be referred to the Network's Medical Review Board (MRB) for review;

Life-threatening situations will be referred to the appropriate State Survey Agency.
Other
Some concerns do not fall under the jurisdiction of the Network or would be more appropriately handled by another agency, such as the state health department. The Network can refer patients to those identified agencies. In more serious circumstances, the Network will contact the agency directly.
Quality Insights encourages resolution of patient and facility staff concerns at the local level whenever possible. However, there may be instances when the individual does not wish to approach the facility staff or provider, but requests Network assistance. It is NOT mandatory that the individual utilize the facility grievance process before contacting the Network.
What the Network Can Do

Investigate grievances filed by patients, family members, or patient representatives to help resolve issues at a dialysis facility or transplant center

Mediate difficult situations between patients and facility staff

Educate staff and patients about issues related to a grievance

Assist patients in understanding their rights and responsibilities and advocate for the rights of all patients

Provide individualized interventions and recommendations for rebuilding positive patient-provider relationships

Help patients identify dialysis facilities through Care Compare and provide contact information for other units
-
Provide general information on Medicare ESRD coverage
-
Provide educational materials and resources about ESRD and treatment options
What the Network Cannot Do
-
Force, direct, or require a facility, transplant center, or physician to accept a patient or change their treatment schedule

Add a patient to the transplant list

Close a dialysis facility
-
Go on-site to investigate clinical procedures, witness staff-patient interactions, or review audio/visual material

Interfere with facility surveys or override state/federal licensing and certification requirements

Change or become involved in facility personnel policies, including facilitating the firing, disciplinary actions, transfer, or pay docking of staff

Change a facility's policies

Require or request that a specific staff member provide care

Require or request that a facility conceal a patient's treatment, behavior or involuntary discharge (IVD) history
-
Verify Medicare coverage or issue Medicare cards, or provide expert guidance on Medicare reimbursement

Recommend a lawyer, assist with a lawsuit, or otherwise assist in pursuing legal action
-
Provide monetary compensation, pay bills, or arrange transportation for patients
-
Resolve disputes involving payment, insurance claims, or billing determinations
-
Request or change medical records
-
Make medical decisions or determine an individual's treatment plan

Release confidential patient, facility, or complaint information
